6 Conditions for Enforcement Under UAE Law
A UAE court must be satisfied on all six conditions before it will issue an enforcement order for a foreign judgment.
Reciprocity
The country where the judgment was issued must recognise and enforce UAE judgments — in the absence of a formal bilateral treaty, this principle of reciprocity must be established.
Jurisdiction
The foreign court must have had proper jurisdiction over the case and all parties involved. Jurisdictional overreach by the foreign court is a common ground for refusal.
Due Process
The losing party must have been properly served and given a genuine opportunity to defend themselves in the original proceedings — the right to be heard is fundamental.
Finality
The judgment must be final and enforceable in the country where it was issued — meaning it is no longer subject to appeal or challenge under the laws of that country.
No Conflict with UAE Law
The judgment must not violate UAE public policy, Islamic law principles, or UAE sovereignty. Judgments contrary to fundamental UAE legal principles will be refused.
Not Already Adjudicated
The same dispute must not already be subject to a pending case or final judgment in the UAE. The principle of res judicata applies across both jurisdictions.

Court Issues Enforcement Order (or Refuses)
After reviewing all submissions, the court issues its enforcement order — or refuses with written reasons. If refused, there are grounds for appeal. If granted, the order has full legal effect in the UAE and enables the next stage of asset recovery. The timeline at this stage is 3–12 months depending on contest.
Pursue the Debtor's UAE Assets
